Terms and Conditions

Please read these Terms and Conditions carefully.

Currency

All prices quoted in Australian Dollars.  Your credit card will be charged in Australian Dollars.  Some banks and credit card companies charge a fee for the currency conversion.  Direct bank transfers from foreign banks will incur additional charges from Martumili Artists.

Duties & Taxes

The paintings for sale on our web do not attract GST as our artists are not GST registered.  When shipping paintings overseas, the purchaser is liable for any other duties or taxes payable specific to the country of import.  Martumili Artists is not responsible, nor able to provide estimates for these charges.  We recommend you contact your customs office for further information.

Payment Methods

For all online orders payments are processed via PayPal. Please refer to Paypal for their terms and conditions. Martumili Artists accepts Visa, Mastercard over the phone. Paintings are posted once payment has been confirmed.

All information received from customers relating to payment details is strictly confidential.

All transactions will be debited / credited to the Shire of East Pilbara Bank Account, this will appear on financial statements.  Martumili Artists is hosted by the Shire of East Pilbara

Pending Payments – If an online order is placed but not paid for within 12 hours it is the right of Martumili Artists to return the work to stock, available for purchase.

International Transactions – The Artists are not registered for GST. As such, GST is not collected on painting sales therefore, GST cannot be claimed back on international purchases.

Provenance

Martumili Artists guarantee all work shown is authentic and the original work of the artist/s named.  The work you receive corresponds with the work shown on the website.  Every painting is accompanied by a Certificate of Authenticity with a corresponding catalogue number which contains a story of the artwork and provides excellent provenance.

Postage and Packing

The cost of postage and packaging is additional to the cost of your purchase.  Martumili Artists aim to provide the most economical and efficient method of delivering your purchase.  All packages up to 105cm in length are posted Registered Australia Post unless other specific delivery arrangements are made between Martumili Artists and the purchaser.  Larger packages will need to be freighted, as below:

National

Our standard charge for parcels under 5kgs to anywhere in Australia is $30AU per package.  Parcels over 5kgs start at $45AU and increase depending on their size, weight and your requirements.

International

Our postage charge for small to medium packages under 5kgs is $70AU.  For larger bulkier items we provide a qote for your approval before dispatching.  We endeavour to send consignments at the most economical rate while guaranteeing their safe arrival.  We use TNT or Australia Post.  While Martumili Artists will make every effort to dispatch as quickly as possible, we cannot guarantee any delivery times.

Refund Policy

We do not provide refunds for art work that leaves Martumili Artists. We work hard to make sure that you as our customer receives value for money and that your goods are delivered in a timely and expedient manner.

Limitation of Liability

Unless otherwise stated, the artworks sold in accordance with these terms and conditions are sold without warranties or representations of any kind.  To the maximum extent permitted by law the liability of Martumili Artists for the sale of any artwork shall be limited to the sale price of the artwork.

Applicable Laws

These Terms and Conditions of Sale of artworks by Martumili Artists are subject to laws applicable in Western Australia.

Martumili Artists warns visitors that our website includes images and artworks of Artists who have passed away which may cause distress to some Indigenous people.

Martumili Artists acknowledges the Nyiyaparli and Martu people as the Traditional Owners of the land we live and work on. We also acknowledge the Traditional Owners throughout our country and our Elders; past, present and emerging.
